These Terms and Conditions (“Terms”) govern access to and use of the Fundin Discover plan (“Discover”, “the Plan”), a self-serve software subscription provided by Fundin (“Fundin”, “we”, “us”, “our”). They apply separately from, and in addition to, the terms governing Fundin’s managed grant and tender application service. Where a User subscribes to both Discover and the managed service, both sets of terms apply to the relevant part of the service used.
By registering for or using Discover, the User (“you”, “your”) agrees to be bound by these Terms.
1. Definitions
- “Discover” means the self-serve software subscription described in Section 2, including access to the grant directory, AI-powered matching, eligibility checking, questionnaires, reporting, and MCP (Model Context Protocol) access.
- “MCP Access” means the ability to connect Discover to third-party AI tools (including Claude and ChatGPT) via the Model Context Protocol, allowing those tools to query Fundin data and functionality on the User’s behalf.
- “User” means the organisation and individuals authorised to access Discover under a subscription.
2. Nature of the Service
2.1 Discover is a self-serve software product. Unlike Fundin’s managed service, no Fundin staff member drafts, reviews, or submits grant or tender applications on the User’s behalf under Discover.
2.2 Discover provides:
- access to Fundin’s grant directory;
- AI-powered grant matching based on organisational data provided by the User;
- automated eligibility checking against grant criteria;
- questionnaires and reporting tools; and
- MCP Access, allowing the User to connect Discover to supported third-party AI tools.
2.3 Fundin may add, remove, or modify features of Discover from time to time. Material reductions in functionality will be notified to active subscribers in advance where reasonably practicable.
3. Eligibility & Account Registration
3.1 Discover is intended for use by charities, not-for-profits, and other organisations acting in a business capacity, not by consumers acting for personal purposes.
3.2 The User must provide accurate registration information and keep it up to date. The User is responsible for all activity under their account, including activity via MCP Access.
4. Subscription, Fees & Billing
4.1 Discover is billed on a recurring monthly subscription basis, charged in advance.
4.2 Subscriptions renew automatically each month unless cancelled in accordance with Section 9. The User authorises Fundin to charge the payment method on file for each renewal.
4.3 Fundin may change Discover’s pricing on notice of at least [30] days. Continued use after a price change takes effect constitutes acceptance of the new price.
4.4 Except as set out in Section 8 (Money-Back Guarantee), fees paid are non-refundable, including where the User cancels partway through a billing period.
5. AI-Generated Content, Matching & Eligibility Checking
5.1 Grant matches, eligibility assessments, and any other AI-generated outputs provided through Discover (including via MCP Access) are generated automatically and are indicative only. They do not constitute advice, a guarantee of eligibility, or a guarantee of funding success.
5.2 The User remains solely responsible for independently verifying eligibility criteria, deadlines, and requirements directly with the relevant funder before submitting any application, and for the accuracy and content of any application it submits.
5.3 Fundin is not liable for any loss, missed opportunity, wasted cost, or unsuccessful application arising from reliance on AI-generated matches, eligibility assessments, or other automated outputs provided through Discover.
6. MCP Access and Third-Party AI Tools
6.1 MCP Access allows the User to connect Discover to third-party AI tools such as Claude or ChatGPT. Use of those third-party tools is subject to the relevant third party’s own terms and privacy policy, which the User is responsible for reviewing and accepting separately.
6.2 When the User enables MCP Access, organisational data entered into or generated within Discover may be transmitted to and processed by the connected third-party AI tool in order to respond to the User’s queries. Fundin does not control how the third-party AI provider processes, stores, or uses that data once transmitted.
6.3 Fundin is not liable for the actions, outputs, availability, or data handling practices of any third-party AI tool connected via MCP Access.
6.4 The User may disable MCP Access at any time via account settings.
7. Data Protection
7.1 Fundin processes personal and organisational data submitted through Discover in accordance with its Privacy Policy.
7.2 Where MCP Access is enabled, the User acknowledges and consents to the data flows described in Section 6.2 as part of their use of the feature.
8. Money-Back Guarantee
8.1 This guarantee applies only to the Discover plan and only to a User’s first Discover subscription period.
8.2 Fundin offers a 30-day money-back guarantee on Discover, conditional on the User having:
- had an onboarding call with a member of the Fundin team;
- followed the action plan agreed during that call, including using the platform’s matching and eligibility tools as advised; and
- not breached any other provision of these Terms.
8.3 The guarantee does not apply where the User has not booked or attended the onboarding call, or has not followed the agreed action plan.
8.4 To request a refund under this guarantee, the User must contact Fundin in writing at support@fundin.ai within 30 days of their first Discover subscription payment. Fundin will confirm the outcome within 14 working days and, if approved, process the refund to the original payment method within 14 working days.
8.5 This guarantee applies only to the first billing period. It does not apply to renewals, repeat subscriptions, or any period after the 30-day window has elapsed.
9. Cancellation
9.1 The User may cancel their Discover subscription at any time via account settings or by contacting support@fundin.ai. Cancellation takes effect at the end of the current billing period; access continues until that date.
9.2 No partial-month refunds are given on cancellation, except as set out in Section 8.
10. Intellectual Property
10.1 Fundin retains all rights, title, and interest in Discover, including its software, directory content, and AI matching methodology. Nothing in these Terms transfers ownership of any Fundin intellectual property to the User.
10.2 The User retains ownership of the organisational data it submits to Discover, and grants Fundin a licence to process that data for the purpose of providing the service.
11. Acceptable Use
The User must not: attempt to reverse-engineer or scrape Discover or its underlying data; use Discover to build a competing product or directory; misuse MCP Access to place excessive load on Fundin’s systems; or share subscription access with organisations not covered by the subscription.
12. Warranties & Disclaimers
12.1 Discover is provided “as is”. Fundin does not warrant that the service will be uninterrupted, error-free, or that grant matches or eligibility assessments will be accurate or complete.
12.2 To the maximum extent permitted by law, Fundin excludes all implied warranties, conditions, and representations not expressly set out in these Terms.
13. Limitation of Liability
13.1 Nothing in these Terms limits Fundin’s liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
13.2 Subject to Section 13.1, Fundin’s total liability arising out of or in connection with Discover, whether in contract, tort, or otherwise, is limited to the fees paid by the User for Discover in the 12 months preceding the claim.
13.3 Fundin is not liable for indirect or consequential loss, including loss of funding, loss of profit, or loss of opportunity, arising from use of Discover.
14. Term and Termination
14.1 These Terms apply for as long as the User maintains an active Discover subscription.
14.2 Fundin may suspend or terminate access to Discover immediately if the User breaches these Terms, misuses MCP Access, or fails to pay fees when due.
15. Changes to These Terms
Fundin may update these Terms from time to time. Material changes will be notified to active subscribers by email or in-app notice at least 5 days before taking effect. Continued use after that date constitutes acceptance.
16. Governing Law
These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute arising from them.
