1. Agreement to Terms

By creating an account and using the Fundin platform, you agree to be bound by these Terms & Conditions. This is a rolling monthly agreement that renews automatically unless cancelled. All payments are non-refundable except where required by UK law. If you do not accept these terms, you must stop using the platform immediately.

2. Platform Services

Fundin provides software tools and AI-assisted support for grant discovery, CSR and corporate funding discovery, tender discovery, AI bid drafting, grant management, case management, organisational reporting, and automated workflows. Fundin may update, improve, suspend, or remove features at any time. Significant changes will be communicated in-app.

3. Scope of Services

Fundin assists with drafting, discovery, and fundraising workflows. Fundin does not guarantee eligibility, approval, funding outcomes, accuracy of third-party information, or funder decisions. Clients remain responsible for final review and submission of applications unless otherwise agreed in writing.

4. Account Responsibilities

You agree to keep credentials confidential, ensure all information is accurate and lawful, notify Fundin of unauthorised access, not share accounts, and ensure your organisation manages workspace access. You are responsible for all activity under your account.

5. Platform Usage Rules

You must not upload harmful, illegal, or infringing content; submit fraudulent information; attempt to hack or degrade the platform; scrape or mass-export data; reverse engineer Fundin’s systems; or misuse AI tools. Violations may result in suspension or termination.

6. Payment & Billing

By subscribing, you agree payments renew automatically, fees are non-refundable for the current cycle, failed payments may lead to suspension, chargebacks may close your account, and Fundin may recover dispute-related costs. Plan prices may change with notice.

7. Service-Level Agreements (SLAs)

Typical drafting timelines: Growth & Managed Plans ~5 working days; Starter/Self-Serve up to 20 working days. Timelines may extend due to complex bids, missing information, or other dependencies. SLAs are targets, not guarantees.

8. Pricing Models

Current pricing is displayed in-app and may be updated with notice.

9. Outcome Notification

Where relevant for your plan, you must update bid or tender outcomes within 5 working days of receiving results.

10. Invoicing & Additional Charges

Invoices for plan upgrades, drafting credits, additional services, or features are payable upon issue. Unpaid invoices may result in suspension, interest charges, or recovery efforts.

11. Suspension of Services

Fundin may suspend or restrict access for unpaid invoices, breaches of terms, excessive usage, AI misuse, or upload of harmful content. Access resumes once issues are resolved.

12. Client Responsibilities

You are responsible for reviewing drafts before submission, ensuring accuracy and truthfulness, verifying funder requirements and eligibility, providing complete information, and maintaining accurate pipeline data.

13. Data Privacy

By using Fundin, you consent to data processing as outlined in the Privacy Policy. You must ensure you have rights to upload data, avoid unnecessary sensitive data, ensure accuracy, and comply with GDPR when using case management features. Fundin acts as a data processor for case management content.

14. AI Use & Data Processing

Fundin uses AI for drafting, summarisation, and automation. Your data is not used to train external AI models. AI outputs may contain inaccuracies and must be reviewed by you. You must not enter harmful, illegal, or highly sensitive data. Fundin is not liable for actions taken based on AI outputs.

15. Intellectual Property

Fundin owns the platform, software, database structure, templates, branding, and proprietary systems. You may use them only for internal organisational purposes. You retain ownership of uploaded content.

16. Termination

You may cancel at any time; cancellation stops future billing but does not refund past payments. Fundin may terminate accounts for breaches, abuse, fraud, or non-payment. All outstanding amounts remain due.

17. Liability Limitations

Fundin is not liable for indirect or consequential damages, missed deadlines, or lost funding opportunities. Fundin’s total liability is limited to fees paid in the previous 12 months. Fundin is not responsible for inaccuracies in funder information.

18. Fair Usage Policy (Drafting & AI Tools)

To ensure service quality, all drafting plans — including “unlimited” — follow a Fair Usage Policy.
The monthly drafting limit per organisation is 20 bids.
Excessive usage includes exceeding 20 bids, repeated rewrites, low-quality inputs, creating content for third parties, automated generation attempts, or uploading unusually large/complex documents. Fundin may request improved inputs, prioritise requests, reduce drafting frequency, restrict access, or recommend plan upgrades.

19. Free Database Terms of Use

Fundin’s free database is informational only. Fundin does not guarantee accuracy, completeness, funding amounts, eligibility, deadlines, or funder decisions. Users must verify information directly with funders.

You must not scrape, export, reproduce, redistribute, automate access to, or commercially reuse Fundin’s data, nor use it to train AI models or build competitive tools. Limited copying for internal use is permitted. All database content is owned by Fundin or its partners.

20. Third-Party Services

Fundin integrates with third-party AI, payment, and communication providers. Fundin is not responsible for outages, changes, or errors caused by third parties. You must comply with their terms.

21. Amendments

Fundin may update these terms at any time. Continued use of the platform constitutes acceptance.

22. Governing Law

These terms follow the laws of England & Wales. Disputes will be handled exclusively by the courts of England & Wales.

23. Accuracy & Fraud Prevention

You must ensure all submitted information is accurate and truthful. Fundin may suspend accounts involved in fraud, misleading content, misuse of data, or attempts to deceive funders. Serious breaches may be reported to authorities if required.

24. Force Majeure

Fundin is not liable for delays or failures resulting from events beyond reasonable control, such as cyberattacks, outages, natural events, strikes, or government actions.

25. User-Generated Content

You are responsible for all content uploaded to the platform. Fundin may remove unlawful, harmful, or infringing content.

26. Marketing & Communication Consent

By using the platform, you consent to receiving service updates and marketing communications, with the option to opt out at any time. Fundin will only use your organisation’s name, logo, or case study information with your explicit permission.
